Terms of Service
Last updated: October 2026. These Terms of Service outline the terms and conditions under which BRIKCODE provides custom software engineering, AI system development, and technical consulting.
1. Engagement & Services
BRIKCODE provides technology consulting, custom AI development, SaaS architecture, automation engineering, and software development services. Every project engagement is governed by a mutually agreed Statement of Work (SOW) or master services agreement defining specific deliverables, timelines, and milestones.
2. Intellectual Property Rights
Unless explicitly agreed otherwise in a specific project contract, all custom code, models, and deliverables created specifically for a client become the intellectual property of the client upon full payment. BRIKCODE retains ownership of pre-existing proprietary frameworks, libraries, and foundational tooling utilized across general engagements.
3. Client Responsibilities
Clients agree to provide timely access to necessary requirements, technical documentation, testing environments, and representative datasets essential for project execution. Clients warrant that all materials provided do not infringe third-party intellectual property rights.
4. AI Capabilities & Warranties
While BRIKCODE builds production-grade, tested, and reliable AI systems, machine learning outputs depend on probabilistic models and training data. BRIKCODE builds robust guardrails, evaluation suites, and monitoring into all production systems, but makes no guarantee of 100% deterministic outputs for generative AI components without human oversight.
5. Limitation of Liability
To the fullest extent permitted by applicable law, BRIKCODE shall not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use software systems post-handover. Total liability is capped at the fees received for the specific service milestone giving rise to the claim.
6. Governing Law & Jurisdiction
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India.
